Dispute Resolution & Litigation

Dispute Resolution & Commercial Litigation in Tanzania

We resolve commercial disputes efficiently, putting amicable solutions through Alternative Dispute Resolution (ADR) first while keeping strong litigation capability for matters that must go to court.

Overview

Resolve disputes efficiently and protect your relationships

Commercial disputes cost more than legal fees. They absorb management time, put business relationships at risk and create uncertainty. In many cases the best outcome is a fair settlement reached quickly. In others, firm action in court is the only way to protect your position.

Nkola Attorneys prioritises negotiated, amicable resolution through Alternative Dispute Resolution (ADR). We assess each dispute early, explain your options candidly and pursue the route most likely to achieve your commercial goals at a proportionate cost. This approach consistently shortens timelines, reduces costs and preserves long-term business relationships.

When a matter must be litigated, we represent clients before the Tanzanian courts with thorough preparation and determined advocacy. We have successfully represented a commercial client in contested litigation, achieving a favourable outcome that protected the client's business interests and commercial position.

FAQs

Dispute Resolution & Litigation: frequently asked questions

Why do you prioritise Alternative Dispute Resolution (ADR)?

Negotiation and mediation are usually faster and less costly than litigation, keep matters confidential and give the parties control over the outcome. They also make it easier to preserve valuable business relationships. We still prepare every matter thoroughly so that, if settlement is not possible, you are ready for court.

Is a mediated settlement binding?

A settlement reached in mediation becomes binding once the parties sign a settlement agreement, and in court-annexed mediation the settlement can be recorded by the court. We make sure the terms are clear and enforceable.

How long does commercial litigation take in Tanzania?

It depends on the complexity of the case, the court and the conduct of the parties. Some matters resolve within months while others take considerably longer. We give you a realistic assessment at the outset and keep you informed as the case progresses.

Is there a time limit for bringing a commercial claim?

Yes. The Law of Limitation Act sets time limits for different types of claims, and claims brought out of time can be barred. Contract claims, for example, generally carry a limitation period of several years. Seek advice early so your rights are protected.

What is the Commercial Division of the High Court?

The Commercial Division is a specialised division of the High Court of Tanzania that hears commercial disputes, with procedures designed to resolve business cases efficiently. We advise whether your matter belongs there and represent you in proceedings.
